Many of my clients are utilizing our law firm to represent them when they are buying a home without a real estate agent. Our law firm charges a flat fee of $1,500.00 to prepare the real estate purchase form for our client, handle all of their negotiations and review all of their real estate closing documents when their purchase is ready to close.
When we are representing Buyers, it is critical that Buyers have the necessary contingencies to provide them with the flexibility in the event their situation changes and they need to terminate their purchase agreement with the Seller.
We recommend that the following contingencies are included with every buyer offer to purchase:
- Buyer to obtain suitable financing to the Buyers complete satisfaction as determined in the Buyers sole and absolute discretion;
- Contingent upon Buyer’s inspection, and review of the entire property, appliances and fixtures to the Buyer’s complete satisfaction as determined in the Buyer’s sole and absolute discretion;
- All appliances in the kitchen, all equipment, and fixtures will transfer to the Buyer at closing. The instruments shall effectively transfer to the Buyer’s absolute full title to the assets free and clear of all liens and encumbrances;
- Contingent upon review and acceptance of the deed and zoning restrictions and covenants, review, acceptance and confirmation of land surveys, plat, surveys map, deed restrictions, review and acceptance of the entire rental history of the condominium unit and all leases executed, to the Buyer’s complete satisfaction as determined in the Buyer’s sole and absolute discretion;
- Contingent upon review and acceptance of all appropriate inspections, land development survey or studies and leases requested by the Buyer to the Buyer’s complete satisfaction as determined in the Buyer’s sole and absolute discretion;
- Seller will repair all of the issues listed by Buyer’s Inspector in his Inspection Report that is attached to this Exhibit A to the Buyer’s complete satisfaction as determined in the Buyer’s sole and absolute discretion; and
- If any of the above contingencies are not agreeable to the Buyer, the Buyer shall notify the Seller within thirty (30) calendar days and shall have the sole and absolute discretion to terminate this agreement.
